These Terms of Use (the “Terms”) are an agreement between you and ComedyBookers, LLC (“ComedyBookers,” “we,” “us” or “our”). They cover your use of the website at comedybookers.com (the “Website”) and any booking request, question or other message you send us through it.
By using the Website, you agree to these Terms and to our Privacy Policy. If you use the Website on behalf of a company or other organization, you confirm that you have authority to accept these Terms for it. If you don’t agree, please don’t use the Website.
1. Booking requests and bookings
- A request is not a booking. Sending a booking request, asking a question or receiving a quote does not reserve a comedian or a date, and does not create a contract.
- Bookings are made by written agreement. A booking is confirmed only when you and ComedyBookers sign a booking agreement (and any required deposit is paid). That agreement, not these Terms, sets out the fee, what’s included, payment, cancellation and the other terms of your event. If the booking agreement conflicts with these Terms, the booking agreement controls.
- Quotes. Prices and availability in a quote can change until a booking agreement is signed. Quotes are based on the details you give us, so tell us about anything that could affect the show, such as the venue, schedule, audience or content guidelines.
- Production services. Sound, lighting, staging and technicians are optional and are included in your booking only when listed in your booking agreement.
- Accurate information. Please give us accurate contact and event details. You must be at least 18 to send a booking request.
2. Information on the Website
We work to keep comedian profiles, photos, videos, categories (such as “clean” or “corporate”), locations and reviews accurate and up to date. They are provided for general information, are supplied in part by the comedians themselves, and may change. Listing a comedian on the Website does not guarantee that they are available for your date. Reviews reflect the opinions of the people who wrote them.
Guides and articles on the Website, including our pricing guide, are general information only and are not a quote or an offer. Your actual price is set in your quote and booking agreement.
3. What you send us
When you send us a booking request, question, review or other message, you confirm that the information is accurate and that you have the right to share it, including any information about other people, such as an on-site contact. You allow us to use it to respond to you, arrange your event and run our business as described in our Privacy Policy. If you send us a review, you allow us to publish it on the Website, edited for length or clarity, with the name and details you provide.
4. Acceptable use
You agree not to:
- break any law, or infringe anyone’s intellectual property, privacy or other rights
- send false, misleading, fraudulent, harassing or abusive requests or messages
- use the Website or the information on it to contact comedians directly to get around ComedyBookers for an event you learned about or arranged through us
- copy, scrape or republish comedian profiles, photos, videos or reviews, or use bots or other automated means to access the Website
- upload malware, interfere with the Website, or get around its security, captcha or rate limits
- impersonate anyone or misrepresent your identity or affiliation
5. Intellectual property
The Website, including its design, text, graphics, the ComedyBookers name and logo, belongs to ComedyBookers, LLC and its licensors. Comedians’ names, photos, videos and other materials belong to the comedians or their licensors and are used with permission. You may view the Website and share links to it for your own planning. You may not copy, modify, distribute or use its content for any other purpose without our written permission.
The Website runs on GigTools, booking management software provided by Jenisan, Inc.
6. Third-party services and links
The Website includes videos from services such as YouTube and Vimeo, uses third-party services for hosting and spam protection, and may link to other websites. Your use of those services is governed by their own terms and privacy policies. We aren’t responsible for third-party services or websites, or for their content.
7. Disclaimers
The Website and its content are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don’t warrant that the Website will be uninterrupted, secure or error-free, or that its content is complete or current.
Nothing in these Terms limits any rights or obligations under a signed booking agreement.
8. Limitation of liability
To the fullest extent allowed by law, ComedyBookers and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Website, even if advised of the possibility. Our total liability for all claims relating to the Website or these Terms will not exceed one hundred U.S. dollars (US $100).
This section applies to your use of the Website. Liability relating to a booked event is governed by your booking agreement. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.
9. Indemnification
You agree to defend, indemnify and hold harmless ComedyBookers and its owners, employees and agents from any claims, losses, liabilities and expenses (including reasonable attorneys’ fees) arising from information you send us, your misuse of the Website, or your violation of these Terms or of any law or third-party right.
10. Governing law and disputes
These Terms are governed by the laws of the State of Arizona and applicable U.S. federal law, without regard to conflict-of-law rules.
Before filing a claim, please contact us at info@comedybookers.com so we can try to resolve the issue informally. If we can’t resolve it within 30 days, any lawsuit must be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you and we both consent to the personal jurisdiction of those courts.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we’ll change the “Last updated” date above. If you keep using the Website after a change, you accept the updated Terms.
12. General
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Website. Your booking agreement governs any booked event.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. If we don’t enforce a provision, that doesn’t mean we waive it.
- Assignment. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
